Terms and conditions
Version: 1 November 2026
1. Scope
These terms apply to all contracts between OnlineBuilders LLC («we») and customers («the customer») for the use of MileEngine · Werkstatt-Cockpit. The offer is aimed exclusively at businesses, not consumers. Deviating terms of the customer only apply if we agree to them in writing.
2. Service
We provide the software as a service over the internet, together with apps for Windows, macOS, iPadOS and Android. The scope follows from the chosen plan as shown on the pricing page or in a quote. Updates are included and installed automatically. We may develop the software further as long as the agreed core functions remain available.
3. Trial period
New customers can try the software free of charge for 30 days. The trial ends automatically; no cancellation is needed. There is no entitlement to availability or support during the trial. Trial data is deleted 30 days after the end if no subscription follows.
4. Conclusion of contract
The contract is concluded when the customer orders a plan in the customer portal or accepts a quote from us. Personal setup services (for example ERP import, conversion of work cards, training) are governed by the respective quote.
5. Prices and payment
The prices at the time of ordering apply, plus statutory VAT. Subscriptions are charged in advance for the chosen period (month or year) and collected via Stripe by card or direct debit; yearly subscriptions can also be invoiced, payable within 30 days. We announce price changes at least six weeks in advance. The customer may then cancel with effect from the change. In the event of late payment we may suspend access after a reminder and a period of 14 days.
6. Term and cancellation
Monthly subscriptions can be cancelled at any time with effect from the end of the current month, yearly subscriptions with effect from the end of the term. Without cancellation the subscription renews for the same period. Cancellation is done in the customer portal or by email to [email protected]. The right to terminate for good cause remains unaffected.
7. Availability
We aim for server availability of 99.5 % on monthly average. Excluded are announced maintenance windows (usually outside normal workshop hours) and disruptions beyond our control. The apps keep working without a connection and transmit data as soon as the server is reachable again.
8. Customer obligations
- Keep login details and PINs secret and block unauthorised persons immediately.
- Maintain data correctly in the leading systems (for example the ERP); the Werkstatt-Cockpit displays it as delivered.
- Only upload content the customer is entitled to use.
- Inform employees about data processing where required.
9. Customer data and data export
All data the customer records remains the customer's data. It can be exported at any time: vehicle records as PDF, all other data as CSV. After the end of the contract the export remains available for 30 days; we then delete the data unless there is a statutory retention obligation. Backups are overwritten in the regular cycle.
10. Data protection
Where we process personal data on behalf of the customer, the data processing agreement (DPA) applies and forms part of this contract.
11. Warranty
We fix defects in the software within a reasonable period after the customer has reported them. If a material defect cannot be fixed, the customer may reduce the fee appropriately or terminate the contract without notice.
12. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. In cases of slight negligence we are only liable for breach of essential contractual obligations, limited to the typical, foreseeable damage and at most to the fees paid by the customer in the last twelve months. Liability for lost profit and indirect damage is excluded to the extent permitted by law. The Werkstatt-Cockpit supports documentation; professional responsibility for the work on the vehicle remains with the customer.
13. Final provisions
[Governing law – to be decided] applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is [place – to be decided]. We announce changes to these terms at least six weeks in advance; if the customer does not object, they are deemed accepted. Should any provision be invalid, the remaining provisions remain valid.
